Artikel 216 2 der Instruktion Dignitas connubii halt fest: Pariter praesumptiones ipse ne coniciat quae discrepent ab iis in iurisprudentia Rotae Romanae elaboratis. Als Norm stellt dieser Paragraph eine Neuheit in Bezug auf das bisherige Recht dar. Der dort angegebene Referenzpunkt der praesumptio iurisprudentiae ist jedoch weder in der kirchlichen Rechtsprechung noch in der kanonistischen Wissenschaft ein Novum.
