Bereits einige Monate bevor die Emissionshandelsrichtlinie im Oktober 2003 in Kraft trat, legte die Europäische Kommission einen Vorschlag zur Änderung der Richtlinie vor. Mit der sogenannten Verbindungsrichtlinie wird das Emissionshandelssystem mit den projektbasierten Mechanismen Clean Development Mechanism (CDM) und Joint Implementation (JI) verknüpft. Gegenstand der vorliegenden Untersuchung ist die Einbettung des CDM und der JI in das deutsche und in das europäische Umweltrecht. Die Verfasserin untersucht die rechtliche Vereinbarkeit der Verbindungsrichtlinie 2004/101/EG mit europarechtlichen und völkerrechtlichen Regelungen und Prinzipien im Hinblick auf die projektbasierten Mechanismen. Gegenstand der Untersuchung ist ferner das Projekt-Mechanismen-Gesetz als nationale Umsetzung der Verbindungsrichtlinie.
