      Article-by-Article Commentary

The General Data Protection Regulation has established a uniform European data protection law, requiring member states to apply European standards and reassess their interpretation criteria. This major commentary, authored by leading European lawyers, deeply analyzes both European and transnational academic discourse. It considers national interpretation approaches within a European legal context, presenting new arguments that enhance possibilities in contentious proceedings. Key advantages include new European law argumentation patterns for national interpretation, a classification of Member States' scope for action, and a focus on pressing topics such as international data transfer, the right to be forgotten, the One-Stop-Shop mechanism, sanctions, profiling, pseudonymisation, consent for data processing, and data protection audits. Contributions come from a diverse group of experts, ensuring a comprehensive exploration of the GDPR's implications and applications. This commentary serves as a vital resource for understanding the evolving landscape of data protection law in Europe.

The principle of Network Neutrality prescribes that all data packets that are being sent through the Internet must be treated equally with respect to their origin, destination and content. It has recently achieved much attention by policymakers in the US and Europe and is debated very controversially. This book seeks to advance this debate by providing a scientific and unbiased view on Network Neutrality, and the related issue of Open Access as policy instruments to counteract the anticipated scarcity of telecommunications infrastructure. The book comprises articles by leading international legal and economic scholars as well as by policymakers on the possible effects of Network Neutrality and Open Access regulation and thus offers a holistic and interdisciplinary viewpoint on these issues.
