    • Die Untersuchung beschäftigt sich mit Wirkungen eines US-amerikanischen Urteils gegenüber Dritten und einer möglichen Anerkennung dieser Wirkungen in Deutschland. Sie befasst sich zunächst mit der grundsätzlichen Anerkennungsfähigkeit eines US-amerikanischen Urteils. Es folgt eine Analyse der Wirkungen gegenüber Dritten sowie deren Anerkennung. Spätestens seit den Diskussionen der 1980er Jahre um einen "Justizkonflikt" herrscht gegenüber dem US-amerikanischen Rechtssystem aus deutscher Sicht eine gewisse, unverändert gebliebene Skepsis. Dieser Skepsis nähert sich die Untersuchung über die Frage der Anerkennungsfähigkeit US-amerikanischer Entscheidungen in Deutschland. Die Verfasserin verknüpft Fragen des Internationalen Zivilprozessrechts mit rechtsvergleichenden Aspekten, indem sie prozessuale Besonderheiten und Urteilswirkungen des US-amerikanischen Rechts darstellt und mit der Untersuchung der Anerkennungsfähigkeit gemäß 328 ZPO verbindet. Im Einzelnen erfolgt eine Analyse von Urteilswirkungen gegenüber beteiligten und unbeteiligten Dritten sowie einseitige Urteilswirkungen.
