Obwohl sich überall sowohl Befürworter als auch Skeptiker zu Wort melden, ist der erlebte Integrationsprozess jeweils ein anderer. Die Beiträge dieses Bandes untersuchen, wie in beiden Kontexten die Möglichkeit der Bildung einer europäischen Verfassungsidentität und die Legitimität supranationaler Institutionen diskutiert werden.

Against the background of early modernism - a period that justified punishment by general deterrence - Kant is usually thought to represent a radical turn towards retributivism. For Kant, and later for Fichte and Hegel, a just punishment respects the humanity inherent in the criminal, and serves no external ends - it is instituted only because the criminal deserves it. In this original study, Jean-Christophe Merle uses close analysis of texts to show that these philosophers did not in fact hold a retributivist position, or even a mixed position; instead he traces in their work the gradual emergence of views in favour of deterrence and resocialisation. He also examines Nietzsche's view that morality rests on the rejection of retribution. His final chapter offers a challenge to the retributivist position, and a defence of resocialisation, in the context of current legal theory and practice concerning the punishment of crimes against humanity.

In the current debate about globalization, its supporters praise its benefits for the economy and for peace while its opponents express their skepticism about its serious consequences for solidarity and democracy in our societies. Yet, the decisive point is already the path towards a global world order as well as the justification of this way. How can globalization of political institutions be conceived of, if it is to comply with the principle of democracy and the rule of law? This volume addresses three central dimensions of this problem: (i) the ethics of international negotiations and agreements; (ii) the question whether global public debate and deliberation might gradually arise; (iii) the issue of the way in which the principles of federalism and subsidiarity could be applied to global political institutions.

Johann Gottlieb Fichtes „Grundlage des Naturrechts“ stellt einen Wendepunkt der Rechts- und Staatsphilosophie dar. Der erste Teil (1796) begründet den Begriff des Rechts und seine systematische Anwendung weder durch eine Grundanthropologie wie im klassischen Naturrecht noch, wie Kant, durch einen kategorischen Imperativ. Der zweite Teil (1797) liefert eine für ihre Originalität, Radikalität und Systematizität bekannte Anwendung. In kritischer Auseinandersetzung mit Immanuel Kants „Rechtslehre“ (1797) entwickelt Fichte eine Vertragstheorie der Regierung und ihrer Kontrollinstanz, eine Theorie des Eigentumsrechts, des Strafrechts, des Ehe- und Familienrechts und des Völkerrechts. In 14 Originalbeiträgen bietet der kooperative Kommentar eine differenzierte, für den Seminargebrauch geeignete Interpretation des umstrittenen rechtsphilosophischen Klassikers.
