The European Regulation on Insolvency Proceedings and Germany=s own body of international insolvency law are becoming increasingly important in insolvency practice. The European Regulation on Insolvency Proceedings is shaped largely by the case law of the ECJ and of the national courts. This commentary examines both this case law and the way in which international insolvency law influences the nterpretation of German insolvency law. The commentary addresses the European Regulation on Insolvency Proceedings, the provisions of art. 102 and art. 102a, sections 1 et seqq. of the German Introductory Act to the Insolvency Statute (EGInsO]), section 335 et seqq. of the German Insolvency Statute (InsO) and selected provisions of German insolvency law.
