This volume features German and Czech legal contributions to the EU constitutional debate, stemming from discussions at a conference held in Oberwiesenthal from 16 to 18 October 2006. The conference occurred amidst uncertainty regarding the future of the Constitutional Treaty signed on 29 October 2004, following negative referenda in France and the Netherlands. In response, the European Council approved the drafting of a new treaty, the Reform Treaty, during its summit on 21/22 June 2007. Subsequently, the Presidency of the Council organized an Intergovernmental Conference to negotiate and adopt this new treaty by the end of 2007. Unlike the Constitutional Treaty, the new Treaty of Lisbon, signed on 13 December 2007, does not repeal earlier treaties but serves as a traditional amending treaty. Despite the abandonment of efforts to revitalize the 2004 Constitutional Treaty, the European Council decided to incorporate many of its proposed amendments into the new treaty. Consequently, the academic discourse surrounding the Constitutional Treaty remains relevant and significant in the context of the ongoing discussions about the Treaty of Lisbon, which the editors and authors aim to address in this volume.
